2. Acceptance of the terms of use
The User undertakes to use the GES Digital Scoresheet as well as to use the content offered in said App ("Content") in a diligent, correct and lawful manner and, in particular, undertakes to refrain from (a) using the Content in a manner, for purposes or with effects contrary to the law, morality and generally accepted good customs or public order; (b) reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying the Content, unless authorized by the owner of the corresponding rights or legally permitted; (c) deleting, evading or manipulating the copyright and other identifying data.
The use of the GES Digital Scoresheet by a third party grants them the status of User and implies full acceptance by said User of each and every one of the conditions included in this Legal Notice.
It is prohibited to carry out any type of advertising or commercial information directly or covertly by sending mass emails ('spamming') without due authorization.
The User undertakes not to introduce programs, viruses, macros, applets, ActiveX controls or any other logical device or sequence of characters that cause or are likely to cause any type of alteration in the computer systems of Indalweb Internet S.L. and/or third parties.
3. Liability regime
3.1. Responsibility for the Use of the GES Digital Scoresheet
The User is solely responsible for any infringements that may occur or any damages that may be caused by the use of the GES Digital Scoresheet, with Indalweb Internet S.L., its group companies, collaborators, employees and representatives being exonerated from any type of liability that may arise from the actions of the User.
Indalweb Internet S.L. will use all reasonable efforts and means to provide up-to-date and reliable information on the GES Digital Scoresheet. However, Indalweb Internet S.L. does not assume any guarantee in relation to the absence of errors, or possible inaccuracies and/or omissions in any of the content accessible through the GES Digital Scoresheet.
The User is solely responsible for any claim or legal action, judicial or extrajudicial, initiated by third parties against Indalweb Internet S.L. based on the User's use of the GES Digital Scoresheet. Where applicable, the User shall assume all expenses, costs and compensation incurred by Indalweb Internet S.L. as a result of such claims or legal actions.
3.2 Responsibility for the operation of the GES Digital Scoresheet
Indalweb Internet S.L. excludes all liability that may arise from interference, omissions, interruptions, computer viruses, telephone breakdowns or disconnections in the operational functioning of the electronic system, caused by reasons beyond the control of Indalweb Internet S.L..
Likewise, Indalweb Internet S.L. also excludes any liability that may arise from delays or blockages in the operational functioning of this electronic system caused by deficiencies or overload in the telephone lines or the Internet, as well as damages caused by third parties through illegitimate interference beyond the control of Indalweb Internet S.L..
Indalweb Internet S.L. is authorized to temporarily suspend, without prior notice, accessibility to the GES Digital Scoresheet for development, maintenance, repair, update or improvement operations.
In the event that the GES Digital Scoresheet may contain links or connections to other portals or sites not managed by Indalweb Internet S.L., it declares that it does not exercise any control over said sites and, therefore, that it will not be responsible for their content. The links that the GES Digital Scoresheet may contain will be offered as an informative reference, without any type of assessment of the contents, owners, services or products offered from them.

4. Intellectual and industrial property rights
All the contents of the GES Digital Scoresheet, unless otherwise indicated, are the exclusive property of Indalweb Internet S.L. and, by way of example, but not limited to, the graphic design, source code, logos, texts, graphics, illustrations, photographs, and other elements that appear in the GES Digital Scoresheet. Likewise, all trade names, brands or distinctive signs of any kind contained in the GES Digital Scoresheet are protected by law.
Indalweb Internet S.L. does not grant any type of license or authorization for personal use to the User over its intellectual and industrial property rights or over any other right related to the GES Digital Scoresheet and the services offered therein.
Therefore, the User acknowledges that the reproduction, distribution, commercialization, transformation, and in general, any other form of exploitation, by any procedure, of all or part of the contents of the GES Digital Scoresheet constitutes an infringement of the intellectual and/or industrial property rights of the company or the owner thereof.
The User may only and exclusively use the material that appears in the GES Digital Scoresheet for personal and private use, and its use for commercial purposes or to engage in illegal activities is prohibited.
The reproduction, distribution and public communication, including the method of making available, of all or part of the contents of the GES Digital Scoresheet, for commercial purposes, on any medium and by any technical means, without the authorization of Indalweb Internet S.L., is expressly prohibited. The User undertakes to respect the intellectual and industrial property rights owned by Indalweb Internet S.L..
Indalweb Internet S.L. will ensure compliance with the above conditions as well as the proper use of the content presented in the GES Digital Scoresheet, exercising all civil and criminal actions that correspond to it in the event of infringement or non-compliance with these rights by the User.
5. Data Protection
Your personal data will be treated in accordance with the "PRIVACY POLICY GES Digital Scoresheet" defined in this document.
6. Exclusion of warranties and limitation of liability
Indalweb Internet S.L., as the entity that technically and organizationally manages the
GES Digital Scoresheet, declares that:
a)
Indalweb Internet S.L. will operate the
GES Digital Scoresheet with a reasonable degree of professionalism and diligence.
Indalweb Internet S.L. will not make any other promises or grant any other guarantees about the
GES Digital Scoresheet and, in particular, does not guarantee that:

the User's use of the GES Digital Scoresheet will be free of interruptions or errors. The User accepts that Indalweb Internet S.L. may occasionally interrupt the operation of the GES Digital Scoresheet for indefinite periods of time or close the GES Digital Scoresheet at any time for technical or operational reasons, in which case it will communicate this circumstance to the extent possible;

the GES Digital Scoresheet will be free of losses, corruption, attacks, viruses, interference, acts of hacking or other intrusions into security, which will constitute circumstances of force majeure, declining Indalweb Internet S.L. any responsibility in relation to such circumstances.
b) For the sake of clarification,
Indalweb Internet S.L. is not responsible, and the User is solely responsible for its contracting, knowledge and control, for any other costs that may be faced for the correct reception of the
GES Digital Scoresheet (other than the specific compensation that
Indalweb Internet S.L. may establish for the specific download of the
GES Digital Scoresheet or all or some of the services and Contents offered through it).
c) Except as provided in section (e) below, or in the event that the User exercises his legal right to receive a refund or compensation, neither
Indalweb Internet S.L. nor its directors, employees, subsidiaries, agents, contractors or licensors shall be liable in any case for any loss or damage caused by
Indalweb Internet S.L., its employees or agents when:

the legal duty of care assumed towards the User has not been breached by Indalweb Internet S.L. or any of its employees or agents;

it would not have been a reasonably foreseeable result of such breach;
-
any increase in loss or damage results from the User's breach of any provision of these Conditions;

is a result of the decision by Indalweb Internet S.L. to remove or refuse to process any information or Content, issue a warning, suspend or cancel your access to the point of sale accesses of the GES Digital Scoresheet (if any) by the User or adopt any other measure during the investigation of a possible breach or as a result of the determination by Indalweb Internet S.L. that a breach of these Conditions has occurred; or

is a loss of income, business or profits or loss or corruption of data related to the User's use of the GES Digital Scoresheet.
d)
Indalweb Internet S.L. will use all possible means to protect the information sent by the User to the
GES Digital Scoresheet, including protection against any type of fraudulent use, and
Indalweb Internet S.L. may request a password change at any time in order to ensure security.
e) Nothing in these Conditions shall exclude or limit the liability of
Indalweb Internet S.L. for fraud, gross negligence, wilful misconduct, death or personal injury.
f) If the User breaches these Conditions, he/she shall be liable to
Indalweb Internet S.L., its directors, employees, subsidiaries, agents, contractors and licensors for any claims arising from such breach. Likewise, the User shall be responsible for any measure adopted by
Indalweb Internet S.L. within the framework of the investigation of a possible breach of these Conditions or as a consequence of the determination or conclusion, by
Indalweb Internet S.L., that a breach of these Conditions has occurred.
7. Right to make changes to the GES Digital Scoresheet by Indalweb Internet S.L..
Indalweb Internet S.L. reserves the right to make, without prior notice, any changes it deems appropriate to the GES Digital Scoresheet, and may change, delete or add the Content, Materials and services it provides, as well as the way in which they are presented or located.
In this regard, access to the Content, Materials and/or services offered through the GES Digital Scoresheet have, in principle, an indefinite duration, unless otherwise provided in the Conditions or in the applicable legislation at any given time. However, the User accepts that Indalweb Internet S.L. may terminate, suspend or interrupt unilaterally, at any time without prior notice, the availability of the GES Digital Scoresheet and/or any of the services, without the User being able to demand any compensation. After such termination, the User must destroy any material obtained in relation to the GES Digital Scoresheet and/or the portal or application in which the Materials and/or Contents are offered, including all the corresponding software and documentation, as well as any copies, printouts and installations.
If the GES Digital Scoresheet is cancelled or terminated, Indalweb Internet S.L. may permanently delete the information associated with your Account, including your Content, from its servers, and Indalweb Internet S.L. will have no obligation to return any Content to you.
8. Modifications to the Conditions.
Indalweb Internet S.L. may replace, at any time, for technical reasons or due to changes in the provision of the service or in the regulations, as well as modifications that may arise from applicable type codes or, where appropriate, due to strategic corporate decisions, the Conditions and the Privacy Policy that, depending on the case, will replace, complement and/or modify the Conditions and Privacy Policy of the GES Digital Scoresheet.
When the Conditions or the Privacy Policy are replaced or modified, they will be published in the GES Digital Scoresheet and/or they will be notified through it, and if the User continues using the service, it will be understood that they have accepted the modifications introduced unless it is necessary to request the User's express acceptance or consent in accordance with the applicable regulations, in which case the User will be asked for such acceptance or consent. In the event that the User does not agree with the modifications made, they may unsubscribe from the GES Digital Scoresheet by following the procedure enabled for this purpose.
The User is recommended to periodically consult the Conditions and Privacy Policy, as they may be subject to modifications. The current version can be consulted in the section “Conditions of Use of the GES Digital Scoresheet”. The validity period of these Conditions therefore coincides with the time of their display, until such time as they are modified in whole or in part.
9. Applicable law and jurisdiction
Indalweb Internet S.L. and the users of the GES Digital Scoresheet submit to the jurisdiction of the Courts and Tribunals that correspond to the rules of procedural distribution.
